Terms & Conditions of Sale

 

1. Application

These Terms govern the sale by Crestar Ltd to you of Pelikan Products (as set out in your order) for which you place an order that is accepted by Crestar Ltd. Crestar Ltd is a supplier and distributor of Pelikan Products. A contract incorporating these Terms will be formed between you and Crestar Ltd for the sale of Pelikan Products when your order is accepted by Crestar Ltd. Crestar Ltd will inform you by email that your order has been accepted. No other terms and conditions shall apply. By placing an order for the Products you shall be deemed to accept these Terms.

 

2. Orders

You can order anytime at www.pelikan-shop.co.uk. Although we aim to process all orders the same day, if you order after 5pm or at the weekend please assume that delivery will be as if your order had been placed the next working day.

All orders placed by you are subject to acceptance by Crestar Ltd. Crestar Ltd reserves the right to revise prices, correct errors on its website and refuse orders at its discretion prior to the acceptance of an order by Crestar Ltd.

Crestar Ltd offers its customers more than 5000 Pelikan branded Products of which the most popular 500 are on our website. We welcome enquiries for Pelikan branded Products not listed on the website and we will quote the price and delivery for these items separately.

If an error is discovered in the price of the Products that you have ordered, we will inform you as soon as possible. In the event that you order an item and the price published on the site is incorrect for any reason, we will contact you upon discovery of the error and no later than the date on which the Products are dispatched to let you know the correct price and ask you whether you still wish us to fulfil your order at this price. We shall be under no obligation to fulfil an order for a Product which was advertised at an incorrect price. Should we have fulfilled the order before discovering the error, we reserve the right to take back the Products and refund you the purchase price or charge you the correct amount.

You may, within 7 working days from the date on which you receive the Products, cancel an order. Please note that orders for Products that have been opened cannot be cancelled. If you wish to cancel your order, please contact www.pelikan-shop.co.uk advising us of the Products’ original transaction number. We will arrange a refund of the price of the Products, less a nominal handling fee, within 30 days of the date you notify us of your cancellation. You will be liable for the cost of postage to return the cancelled Products and will be under a duty to take reasonable care of the Products until they are returned.

Following the expiry of such 7 working day period, you may not cancel an order which Crestar Ltd has accepted without the agreement in writing of Crestar Ltd, which requirement may be waived by Crestar Ltd from time to time in its sole discretion. Ownership and title remains with Crestar Ltd until full payment for Products has been received.

 

3. Delivery

Because we know how important it is to get the supplies you need, we aim (but do not guarantee) to deliver all orders to addresses in mainland UK within two working days of payment being received. Crestar Ltd cannot be held responsible for any consequential loss due to late or non-delivery.

We will deliver your order via third party specialist carriers including the Post Office and cannot, therefore, specify when deliveries will take place. The delivery driver will need to obtain a signature for all parcels. If you are unavailable to accept delivery, your order may be left with a neighbour if they are willing to sign for it. Please note parcels cannot be left in porches, sheds etc. Most deliveries are attempted twice and the driver will leave a card stating when delivery will be re-attempted or if the parcel has been left with a neighbour, or if the parcel is available to be collected from your local Post Office. If two delivery attempts have been made and the Products remain undelivered, please contact us and we will provide you with reasonable assistance to enable you to collect the Products. Please state when ordering any helpful information that we can pass to the delivery service provider that will facilitate a first time delivery.

Delivery to the UK mainland is free on all orders over £50.00 (ex VAT).

Orders below £50.00 excluding VAT will be charged postage and this amount will be displayed on the shopping page before you finalise the transaction.

Please note we cannot deliver to PO Boxes or BFPO addresses.

 

4. Payment

All payments will be made by credit or debit card and Crestar Ltd accepts all major cards. Please refer to our privacy policy for details of how we process your details [INSERT LINK TO PRIVACY POLICY]. Payments will be taken by Crestar Ltd, and this is the name that will appear on your Credit/Debit card statement.

Crestar Ltd guarantees to provide PCI compliant secure payment services and the transaction will go through the http://www.pelikan-shop.co.uk website.

If you require the Products to be delivered to an alternate address other than that which your credit card is registered to, we may need to verify your details before we can process your order.

Crestar Ltd reserves the right, by giving you notice prior to the contract being formed to increase the price of the Products to reflect any increase in the cost to Crestar Ltd which is due to any factor beyond its control.

 

5. Returns

Please see section 2 for details of cancelling orders that are not faulty.

If, within the three years from the date of delivery, you wish to return Products that are faulty please contact www.pelikan-shop.co.uk advising us of the Product(s) original transaction number and reason for return. A Crestar Ltd operator will contact you within 5 working days to arrange the return. Only returns that have resulted from an error on our part (wrong or faulty Products) will be credited with postage costs.

 

6. Damaged, Missing or Faulty Items

If any items are damaged or missing from your order, please contact us within 3 working days of your delivery via our website www.pelikan-shop.co.uk .

 

7. Warranty

Subject to the limitations on its liability set out in these Terms, Crestar Ltd warrants that the Products will be materially free from defects in material and workmanship for a period of three years from the date of delivery. Crestar Ltd shall be under no liability in respect of any defect arising from fair wear and tear, wilful damage, negligence, abnormal working conditions or misuse. If you notify Crestar Ltd of a valid claim for a breach of this warranty within the three year period, Crestar Ltd will replace or repair the Product or refund the price of the Product, at Crestar Ltd’s discretion, but Crestar Ltd shall have no other liability to you.

 

8. Liability

Nothing in these Terms shall exclude or limit Crestar Ltd’s liability for fraud or for death or personal injury caused by its negligence or any other liability to the extent that the same may not be excluded or limited as a matter of law. Without prejudice to the previous sentence, Crestar Ltd shall not be liable for any loss of income or profits or for any indirect or consequential loss or damage of any kind howsoever arising and whether caused by the negligence of Crestar Ltd, its breach or non-performance or any of its obligations under these Terms or otherwise. Crestar Ltd will not be in breach of these Terms arising from or attributable to acts, events, omissions or accidents beyond its reasonable control. These Terms set out the full extent of Crestar Ltd’s obligations and liabilities in respect of the sale of the Products. In particular there are no conditions, warranties or other terms, expressed or implied, as to satisfactory quality, fitness for a particular purpose or of any other kind whatsoever, that are binding on Crestar Ltd except as specifically stated in these Terms. Any condition, warranty or other term concerning the sale of the Products, which might otherwise be implied into or incorporated within these Terms, whether by statute, common law or otherwise, is excluded to the fullest extent permitted by law.

 

9. Data Protection

The personal information you provide to Crestar Ltd consists of your name, your postal and e-mail addresses and other contact details as well as order, delivery and billing information; it will be maintained as part of our customer records for the purposes of credit checking, direct marketing, delivery of orders and Product purchase history. You may also receive news and marketing offers from other Crestar Ltd companies and Crestar Ltd’s business partner vendors. This information will be stored, namely, on our centralised database in the United Kingdom. Crestar Ltd may also need to make your records available to our professional advisors, such as lawyers, accountants, regulatory authorities or other governmental administrations. Most of these other parties will be located in the European Union, but others may be based, or have operations, outside of the European Union.

You can contact Crestar Ltd at http://www.pelikan-shop.co.uk at any time to see the information held about you and to ask us to make any necessary changes to remove or correct it or to object against any further use of your personal data by Crestar Ltd for direct marketing purposes. Further information as to the right to protect your personal data is available from the Data Protection Registry in the United Kingdom. By entering into any agreement with Crestar Ltd or providing Crestar Ltd with personal data, you consent to the processing and transfer of such data in the manner and for the purposes described here above.

 

10. General

Crestar Ltd shall not be liable to you for any loss or damage which you might suffer arising from Crestar Ltd delay in fulfilling or failure to fulfil any of its obligations under these Terms to the extent that such delay or failure is caused by any circumstance beyond Crestar Ltd’s reasonable control. These Terms and any terms appearing on any order form to which these Terms apply constitute the entire agreement between you and Crestar Ltd relating to the Products. The failure of Crestar Ltd or you to enforce any of these Terms does not constitute a waiver of that term and shall in no way affect the right later to enforce the term. The invalidity or unenforceability of any clause of these Terms shall not adversely affect the validity or enforceability of the remaining provisions. No amendment, variation or addition to these Terms shall be binding unless agreed to in writing by an authorised representative of Crestar Ltd. Crestar Ltd reserves the right to amend these Terms and so you are advised to read these Terms when you place any future orders. The Terms that are in place when an order is accepted shall apply to that order. Crestar Ltd may transfer any contract with you concluded on these Terms or any of its rights or obligations under any such contract. These Terms will be construed in accordance with the laws of England and any disputes shall be settled by the English courts.

The above Terms do not affect your rights under law. Please contact the Citizen's Advice Bureau should you wish to establish your rights in more detail.
